Welcome to The Suitor, a service owned and operated by The Suitor, LLC, a Virginia limited liability company (“Company,” “we,” “us,” or “our”).

By accessing or using our app, website, or services (collectively, the “Platform”), you agree to these Terms & Conditions (“Terms”) and our Privacy Policy.
If you do not agree, do not use the Platform.

The Suitor is a digital platform that allows users to:

• Offer their time and companionship for pay (“Sought”), or
• Hire others for specific activities, events, or companionship (“Suitor”).

The Platform facilitates connections and payment processing only. The Company does not employ, supervise, or control any user. All interactions occur at users’ discretion and risk.

• You must be 18 years or older to use the Platform.
• You must provide accurate personal information and maintain only one active account.
• You agree to comply with all federal, state, and local laws when using the Platform.
• You may not use the Platform for illegal, sexual, or exploitative activity.

• The Suitor is not a dating or escort service.
• All payments are for time and companionship only, not for physical or sexual conduct of any kind.
• Any sexual or illegal activity between users, whether paid or unpaid, is strictly prohibited and will result in permanent removal and possible legal referral.
• The Suitor acts solely as a third-party technology platform to process payments and maintain safety tools.

• You are solely responsible for your personal safety and the accuracy of information shared.
• You agree to meet in public places for all first-time bookings.
• You agree to use in-app messaging and video tools only until after a booking is confirmed.
• You must use the Clock In / Clock Out function to ensure accurate time tracking and payment.
• You will not solicit or offer illegal services through the Platform.

• Every page of The Suitor contains an SOS Button that immediately calls 911 when pressed.
• The Company encourages users to share meeting details with a trusted contact.
• Background checks may be offered but are optional; The Suitor is not responsible for their accuracy or completeness.
• The Company reserves the right to remove or ban any user for safety violations, suspicious activity, or misconduct.

• The Suitor charges the Suitor (hirer) for the agreed rate set by the Sought plus a 10% platform fee payable to The Suitor, LLC.
• The Suitor, LLC collects and disburses payments to the Sought after completion of the booked time.
• All Sought users are independent contractors, not employees of The Suitor.
• Each Sought user is responsible for reporting and paying applicable taxes on income earned through the Platform.
• The Suitor, LLC may issue Form 1099-NEC to qualifying Sought users at year-end.

You agree not to:

• Use the Platform for illegal, sexual, or discriminatory purposes.
• Harass, harm, or threaten other users.
• Circumvent payment systems or conduct off-platform transactions.
• Impersonate another person or misrepresent your identity.
• Post false, defamatory, or offensive material.

Violations may result in immediate termination and potential referral to law enforcement.

By using The Suitor, you agree to release and hold harmless The Suitor, LLC, its owners, affiliates, agents, and employees from:

• Any injury, harm, loss, theft, emotional distress, or damage arising from interactions with other users,
• Any illegal conduct, negligence, or actions taken by other users, and
• Any outcomes or experiences resulting from meetings or communications initiated through the Platform.

You acknowledge that you are entering any interaction or meeting at your own risk and that The Suitor, LLC is not responsible for any damages, misconduct, or incidents arising from user-to-user contact.

• You agree that any dispute or claim arising from your use of the Platform will be resolved through binding arbitration in the Commonwealth of Virginia.
• You waive your right to participate in a class action lawsuit.
• Virginia law governs these Terms.

The Suitor, LLC reserves the right to:

• Suspend or terminate any account at any time for violation of these Terms, unsafe behavior, or suspected fraud.
• Modify or discontinue any part of the Platform at any time without notice.

The Platform is provided “as is” and “as available” without any warranties of any kind.
The Suitor, LLC does not guarantee continuous, error-free, or secure service, nor endorse any individual user.

In no event shall The Suitor, LLC or its affiliates be liable for:

• Indirect, incidental, special, or consequential damages, or
• Losses resulting from user-to-user interactions, including personal injury, emotional harm, or death.

Total liability to any user shall not exceed the amount of fees paid to The Suitor, LLC in the 3 months preceding the event.

You agree to indemnify and hold harmless The Suitor, LLC and its agents from any claims, losses, or damages arising out of:

• Your use or misuse of the Platform,
• Your breach of these Terms, or
• Your violation of another person’s rights.

The Suitor, LLC may update or modify these Terms at any time. Updates take effect immediately upon posting. Continued use of the Platform constitutes acceptance of the revised Terms.
